
Against every principal of justice accepted globally, you take your prisoners to a remote part of the globe, with no access to the outside world, no charges and no right to seek legal help. You keep them for months, years, heck as long as you wish, then appoint some of your own people to defend them without offering the detainees any input in the process. The situation is so bad, your own people you appointed are disgusted by the unfair nature of the "trials" you are holding.
What to do, what to do? FIRE 'EM! That's what! Problem solved. American style!

If it's a "war on terror" people you catch should be considered prisoners, I don't think anyone is aruging that you have to let them go rather that you have to apply the basic principals of the law. You are also assuming that they are all figthers and foreign some of them are ordinary afghans, in fact some that have been released were given nothing more than a pair of jeans and a plane ticket back.

Of course if that doesn't work, then we threaten the world too. Evil Empire? Just an Empire with a few Evil people in charge of it for now, unfortunately.
